Moses instructs Israel to set apart three cities of refuge once they possess the land, dividing the territory into three regions so that anyone who kills someone unintentionally, without prior hatred, can flee there quickly for safety from the avenger of blood, “lest the avenger of the blood pursue the slayer, while his heart is hot.” Moses clarifies that this protection does not extend to a genuine murderer, someone who hates his neighbor and lies in wait to kill him deliberately, who must be handed over to die instead, “so shalt thou put away the guilt of innocent blood,” the Hebrew phrase “dam naqi,” from Israel.
Moses commands that ancient landmarks and boundary stones set by earlier generations must never be moved to steal a neighbor’s land. He reaffirms the requirement of two or three witnesses before anyone can be convicted of any crime, refusing to allow a single witness’s testimony to establish guilt. Judges and priests are instructed to investigate diligently whenever a witness is suspected of testifying falsely.
If a witness is proven to have lied maliciously against another person, Moses commands that the same punishment intended for the accused be applied instead to the false witness, “life shall go for life, eye for eye, tooth for tooth, hand for hand, foot for foot,” so that others will hear and fear, and such wickedness will not continue among them. This principle ensured that the legal system’s protections against false accusation carried real, tangible consequences for anyone who tried to abuse it.
The severe penalty for false witness, receiving exactly what they intended to inflict on someone else, protected Israel’s entire justice system from being weaponized by malicious accusation. Real justice, this chapter shows, requires not only punishing genuine wrongdoing, but actively protecting the innocent from being falsely condemned in the first place.
